Maybe the Lafayette Citizens can help me. I will tell you what my statements were in the council meeting the other night. Let’s begin with those.

Debbie Schley: Um I just want to know tonight, I want to know if um are we putting Diane Rinks to rest tonight now that she’s no longer here. Are we done blaming her for the problem? Is that done? I’m asking you. No I have another question. So you won’t answer that question? Ok so we’ll still blame her for the problems. Number two would be um now the council’s taking responsibility for anything that happens with the city regarding water issues not Jim

Mayor Heisler: No I don’t think that has been implied either. Is that a question?

Me: Yea

Mayor Heisler: I don’t think we’ve come to that conclusion.

Me: Okay so cause I find that the committee’s were supposed to be a resource and that we were still supposed to use our expertise of people but it seems like now he is the new target. Trena’s gone now he’s the new and now were going after Jim with 10 years of experience and it just seems that were not happy if were not going after somebody. So now its Jim’s turn. So I just find it frustrating and when you use terms like not all of us disagree of we all together or something please don’t use those terms because there are some of us in the audience that don’t agree with you and not all of us citizens are with you. There some of us that are not with you and I want to make that very clear.

Mayor Heisler: I appreciate it.

Me: No you don’t seem to understand that and you still seem to continue to think that were 100% behind you and there are a good number of us that are not behind you. So I just want to make sure you understand that.

Mayor Heisler: Is there anymore?

Me: I think I’m done.

I will talk about Mayor Heisler, Councilor Chris Pagella, and Councilor Leah Harper’s obsession with Diane Rinks in another story. But I wanted it on record that they will not let it rest. Diane left this town and never looked back on December 22nd 2009. She has moved on with her life but apparently these people cannot. The citizens would like them to but they won’t. Like Nick said, “Why do we learn from History? To learn from our mistakes.” End Quote. But we go onward. We don’t live back in history. They have been after Diane Rinks since documents that I have dated May 5, 2007 when they were known as the Concerned Citizens for a Better Lafayette. Refer to the documents but let me give you examples from those documents about what they had on their agenda’s regarding Diane Rinks.

Documenting neglect of duties and abuse of taxpayer dollars by City Administrator. Gathering all the facts to be brought to each individual Council member to force them to take a stand against corruption. Our City Administrator, Diane Rinks, and has been employed by our city for almost 4 years. She was terminated from her last position as City Administrator in the city of Brownsville, Oregon shortly before being hired by Lafayette. Cover replacing City Administrator Process. Circulate Petition to replace City Administrator. Our City Administrator was fired from the last city she worked for. Despite citizen concerns, our Council refuses to hold her accountable or monitor her spending. She violates our city Charter, Mission Statement, and the responsibilities laid out for her in the City Employee Handbook. Yet Council ignores citizens complaints.

That is just a few. If you read everything on their website you would see the obsession. What I don’t understand is that we have due process in place for people who commit crimes, or ethic standards, or the Attorney General, etc. Why is it Diane never ever was proven to be guilty on so many of these accusations and I use the word accusations because none of these things have never been proven or she would have been guilty and consequences would have followed. Again Mayor Heisler, Councilor Chris Pagella, and Councilor Leah Harper are not fully serving this City if they cannot get on with the past and move to the present. We need strong leadership that wants to lead now and work for the City with our present circumstances. We cannot go get Diane Rinks at her house bring her in to the Council meeting and scold her. She has moved on and is enjoying every part of her retirement and probably in some sort of way getting a kick out of the fact that these people just cannot get over her. That is all I am going to say on that subject for now.

The next would be Pro-Tem City Administrator Trena McManus made a comment to the news register let me quote it for you and you can go there on line and look it up. It is the Wednesday July 21, 2010 paper. The paper states that she conceded that her departure was motivated partly by council fire. Pro-Tem City Administrator Trena is quoted as saying, “I would be lying if I said it didn’t,” she said. “So yes, it definitely plays a role in my decision.” So now we have two Councilor’s recalled from the Mayor Heisler, Councilor Chris Pagella, and Councilor Leah Harper’s Regime and they are now being accused by the Pro-Tem City Administrator of the Council treating her in a way that she felt she needed to leave the City after 10 years of employment. Yes there are those who really liked her and I would say that would probably be the majority and then there are those that are probably not going to miss her. But now we are two Councilor’s down, hold on, wait, one more resigned. Ok three Councilor’s down and a Pro-tem City Administrator. I would say that they are definitely not helping the City but making it fall apart.

Now there next target Public Works Forman Jim Anderson. You know what all these people have in common. Diane Rinks. The three Councilor’s liked here. Pro-Tem City Administrator Trena McManus liked her and they worked well together. Public Works Foreman Jim Anderson worked with her and liked her. Uh oh that is not good. To them you are not suppose to like Diane Rinks. The meeting went around and around and around that night. This City has had the same system in place and now all of a sudden its wrong by three people who have no water experience what so ever. But they have figured it out and have become experts in less than two years. Were supposed to believe them over Public Works Director Jim Anderson and his 10 Years on the job experience. He is trained with every level through the state with where he needs to be. He is definitely qualified for his job. No one has said that he is not. It is who is going to tell whom what to do. Scary…. I have always came from areas way bigger than Lafayette that had odd/even watering days. Yeah the grass turns yellow and guess what folks it comes back in the fall. No big deal. The past 4 years in September it will be for us here in Lafayette it has been no big deal. Watch out Jim I will definitely be watching over you. I don’t think they will be happy in my opinion until they totally clean out all the employees in City Hall.

Now my last question was because the Mayor believes that he has 70% of the Citizens in Lafayette on his side. It is really strange because even in my neighborhood I know of some who don’t agree with him and at the meeting I can name to all of you the same people who come every single time. So where are you folks? I hope and pray you read all the facts presented in front of you. One serious fact that you should be thinking about right now is that we have tried and convicted without any testimony or trial or evidence presented from the other side and the other side is the City of Dayton. The Mayor, Councilor Pagella, Councilor Harper as you read the letters that have been sent out to you or the one we put on line state firmly operator error. We are not working with Dayton we are accusing Dayton. I have asked on several occasions not to go down this road until a representative from Dayton could be present to explain to our City how this works. If you believe the Mayor then I feel really sorry for you because you haven’t even given Dayton a chance to even tell you what the whole contract is about and how it works. You have only taken Lafayette’s point of view from Mayor and two Council members. When you have a contract with another party you work together. You don’t attack the other person. It is going to be real interesting how we recover from this situation and the damage that the Mayor and his two Councilor’s have done. If you want the whole truth you would here Dayton’s side of the story and know how the system was put into to place because I will tell you now I have taken the time and there is a whole different take and we have rushed to judgment. I thought as a town we were better than that. I wouldn’t want another town attacking us and making false accusations.

The Mayor and the Councilor’s are definitely not setting a good example on how to lead. Councilor Nick Harris is not on that statement because he refused to put his name on it and I think it was the right thing to do. Councilor Nick Harris did walk out of the Meeting that night because the meeting was going no where. He didn’t storm out. He just gave his input listened and decided as you here him say what was happening. At the end of the meeting it is as exactly as Councilor Nick Harris put it accept he was lucky because he got to go home early and spend some time with the family where as the rest of us had to suffer through some more of there around and around the merry go round we go thinking. Where we stop no one knows. And to be honest with you nothing really happened in all that time frame accept accusations. So it was no big deal that Councilor Nick Harris didn’t want to play Merry go round that night folks but if you read there page you would think the world was coming to an end. I don’t know how they come up with there writing. It is simple Councilor Nick Harris stated his opinion and then left the meeting that night early. He committed no crime folks.

I guess now we will have to see what they will do to the Public Works Director Jim Anderson will they make it more difficult for him on the job so that he will want to leave? Will they give up on the past and finally move forward and leave Diane Rinks alone? Will they apologize for their actions against the City of Dayton? Will they start working with them and stop accusing them for all our problems. Will the Mayor follow his Mission Statement quote “opportunity to serve the town that has become his home.” Even those that disagree with him and are not in his regime. Quote “Ensure that all residents’ dealings with city government are fair and consistent.” That even means with me I am a resident and I am dealing with him and two Counselor’s that I don’t agree with. He stated to me in the parking lot one night after a meeting that when it comes time to open discussion that he looks at the content not the time. Now who is he to judge each and every one of us on our content as to what he believes is good content to him where as it is a 100% important to us? It is called open discussion and the right to freedom of speech where no one can shut you down on what you think is important to what you say. That comment right there told me everything. For those of you who disagree with him your content is no longer important. But everyone else’s is. Sorry folks I just call it how I see it. This is my opinion. Refer to the meeting and the documents for you proof to backup my statements and the News Register.

Meeting information just to address what happened. I would really love it if you watch the video. The most important part for me for you to watch is at the time when Angela is just questioning the attorney about the laws on Public Meetings and video taping. But it then turns into accommodations for Angela, because she is deaf and needs to see the person to see the lips. At this point, I had only asked one question regarding taping. Not only did Angela then have to make arrangements that night for her disability, but also it brought an enormous amount of attention that didn’t need to be brought to someone with a disability. Listen and you will hear from the left, front side of the room. It is Chris Harper. That is right: Councilor Leah Harper’s husband who makes an incredible statement that just sends me through the roof.

So you will hear me asking if he has a disability and getting upset at his statements. I couldn’t believe it that the Mayor would let someone stoop so low. Guess what? Watch the video. Who does the Mayor take his anger out at? He looks and yells directly at me as usual. It has happened in previous meetings, which when they are put on the site, I will go over those with you also. Does Chris Harper get tossed out of the meeting for making fun of someone’s disability? Has he made other remarks about this person before and got away with it? Yes. It is all on other videos, which you will now be able to see.

If you’re a friend of the Mayor’s, you are allowed to do anything. Mark that down on the list; don’t seem to have any care for someone who has a disability, Lafayette Citizens. I guess that takes some of you voters out of the picture now too. Otherwise, he would have done something more to show some sort of respect. At least that is the right thing to do, regardless if it is your best friend making that comment.

Now his website states: July 22 special meeting that was set up to conduct interviews with the city Administrator candidates, things were off to a rough start as two or three citizens threatened to cause a commotion through disruptive outbursts and repeating behaviors from the July 8th council meeting.

As the meeting began two citizens were speaking out of turn, not waiting to be recognized and attempting to engage in an argument with the City Attorney and Mayor.

We apologize, to all you Lafayette Citizens, that we fight for your rights and to show you how much Mary Heisler and her website has it wrong. Clearly Angela and Darrell are asking questions because they have the right to tape the meeting and he didn’t come back with a correct ORS number. They complied. I guess you can’t question them. I think for those of you who can’t make it to the meetings, enjoy watching the videos. We do spend our time for you.

Mary Heislers website: The citizens were forced to follow the appropriate decorum for a public meeting and no further outbursts occurred. The city’s attorney also had to stop one of the citizen’s video setup, stating it was a violation of the candidates privacy.

Again, no proof. The Floods have done a ton of research, and nowhere does it state any of this. But because of who they are, for that night they complied. Now you don’t see those words, do you? You don’t see names because Mary won’t state our names. She definitely won’t put her friend Chris Harper on there.

Do any of you see anything wrong with this? Something is wrong, folks. Again, you are not getting the truth. They are trying to smear other people, although they won’t name us. I wish they would. Heard of a lawsuit?

This is how Debbie Sees It. Stay tuned because we have great video of the Mayor constantly yelling at me when I ask if he will quiet some of his people in the audiences when they are mocking the other councilors or again defending someone. You will see it. Is that how the Mayor should respond in an outburst yelling like that? You notice we don’t use all Mary's ridiculous terms: threatened, commotion, disruptive, outbursts, repeated behaviors, engage, argument, and forced. WOW!

I am trying to figure out why so many Lafayette Citizens were so taken by Al LeMay, the recall, etc….
Al is with the Mayor Chris Heisler’s Regime and was chosen to sign the documentation to do the financial part of the recall for the petition to get Councilor Bob Cullen and Councilor Dean Rhodes recalled. He was also behind Trevor Higby and his attacks that the Citizens of Lafayette are now finding out to be lies and mistruths. Come to a meeting and ask your Mayor for him to lower your water rates. We did in July’s meeting he didn’t do it. Councilor Michael Roberts asked on behalf of the Citizens for a $600,000.00 refund check. Heisler cannot come up with it. Remember all those Water Task Force flyers they gave you. Not True.

Now come to find our Al LeMay has a position on the Republican Party and lives in Lafayette but for some odd reason since he registered through the Yamhill County Elections Office in October 2008, he used a Washington Drivers License. His vehicles both have Washington License Plates. Is he trying to tell us he doesn’t want to become an Oregonian? It has been two years. The Yamhill County Sheriff’s Office and the Department of Motor Vehicles state that you have 30 days to change your vehicle tabs and 6 months to change your driver’s license. What is he waiting for? Has he not caught the Oregon bug like the rest of us? Something is definitely wrong to work on a recall and not abide by Oregon Revised Statues, which pretty much are the laws, and then work for the Republican Party, and then work for Mayor Heisler’s group. Apparently transparency is ok even if it means you break a law. But you have to be on their side.

Now Trevor Higby which you all came to know and love. Let’s talk about some of his writings on some other Facebook pages and see if you still love him after that. If you’re a Democrat, I must warn you this isn’t pretty.

Well, what can I say? These are just some of Trevor’s words to live by. I think all of you Democrats might want to think about where you stand with this group right now. I bet I opened your eyes just a little bit.

Well can you take a little more? I had two conversations with two witness’s regarding Justin Boone and the allegations especially the harassment charges that one bothered me the most. Justin stated the first time, in person, no one and he made it very clear no one at all, had harassed or bothered him in his position. Then per a second conversation he stated it, again, but then slipped and said I am going to have to call Mayor Heisler and ask him what this harassment means. I lost it and came unglued. I said Justin you have to be kidding me. He then got really nervous and wanted to know if anyone knew about the conversation. I couldn’t say that someone could hear it because I wanted a witness to the truth and it had just come out. I said Mayor Heisler is involved in all this. He tried to change it but in the end he couldn’t and just gave in.
I promised I would never say anything and I didn’t. He is no longer here and now is the time for everyone to know the truth. He also mentioned the there was a hostile environment happening at City Hall between him and Trena McManus. What are these people up to? I didn’t want any part of this.

There you have it folks. I will continue to go through Justin’s emails where the Mayor has asked him to email him at his work email at cjheisler@autotrader.com. Transparency folks - this is what you asked for. I have documentation to back this up. I have witnesses to the conversation. I don’t know completely the extent, but the Mayor was mentioned and then you bring in Al LeMay and Trevor Higby. Quite a team to impact two other people’s lives when you look at theirs. I hope the citizens of Lafayette start paying attention and not listening to those who preach, but those who teach because you are about to get a lot taken from you - more than you will ever know.

Keep reading - I will continue to keep you informed. Just to let you know I do live among these people. Not proud of it but I’ve known some of them since 2006. I know how they work.

I am requesting information regarding the names of your committees. Who are on those committees? When do they meet? Some of us citizens would like to attend. I am holding you accountable for the transparency that you talk about. I find it was interesting to listen to a councilors husband Chris Harper who is on your Water Task Force give a speech that I would think would be informational and factual. What I am now finding out isn't completely factual. But then he directs his anger toward two council members and a person who no longer is here. I am beginning to think maybe at one time George W Bush drove through here and he possibly is to blame for our water problems too. I would think these committees would be formed to advise you and help you and the Council and the public gain knowledge to then take and use to do what is best for the benefit of the City. Bring the City together. But instead it is being used to divide the City and attack people. Personally, I think you give Bob Cullen and Dean Rhodes some amazing power and gifts. If they can control and do the things with water as you say, I need some help with some things. People need to know so thousands can flock to our town and see their amazing talents and gifts they were born with. Even Diane. Maybe she is still using them or they go away once you leave this City. You benefit a City by knowledge and then gathering together that knowledge and working with it. Not one group continuously saying they have all the knowledge and, supposedly the expertise. We have no evidence of this. The fact that you lead and take recognition for this group just leads me to believe that you are not willing to work together with anyone. Oh, accept only those in your group. If anyone has divided this town it has been you and your committees. Please get back to me so some of us that are not bipartisan can attend and really get to the bottom of the issues and help this City grow and progress to what it really can be and not be a block in the road stopping all movement so that it will never go anywhere. Included are attachments which I think are important. They say it all. You were from the beginning wanting to Control Lafayette and these documents speak wonders. The hardest part is how you didn't accomplish much. A mayor with so many promises but then blames old government so then he gets into office and now it is new government. Have you ever thought about taking responsibility for your own actions.

You have held Anger, Resentment, and God knows what toward Diane Rinks. Will you ever give it up? According to these papers they go back almost about 4 years now. I have never seen anyone in my life time hold that long of those feelings. They usually move on.

That is a good one. I have had two complaints into the City with absolutely no response what so-ever. So are you picking and choosing the Citizens that just listen to you?

Work to develop a completely transparent government where citizens will have the opportunity for FREE information and access to the City Staff and Government.

Apparently that only applies to Councilor Leah Harper and that is also personal information too.

The Code Compliance - Committee I will get back to that one because all the Citizens need to know is you just want to change the City and make it all NEW LAFAYETTE. Get rid of the old and bring in the new. That's why complaints have doubled since the development you moved into. Or maybe it is just the people in your regime.

Regain the trust between the residents and the leadership of Lafayette.

Was that through your website Oh, I am sorry. I mean the one you use and is your wife's website. By talking badly about people. Writing misinformation. Using scare tactics. Fear. The list goes on. I guess I don't understand your style.

All someone needs to do is read all these documents. You spell it all out. I hope you remember them. They should bring back memories. Lets see if you honor your word take care of my complaint and provide me with my information I need.

I just wanted to let the Council know that it is not over definitively not over with the public and private information that has been breached at the City of Lafayette. No one from the City, Council, or Attorney's office can state 100% that no personal information was exposed. Leah had access to a computer that had personal information on it. She has given us two stories on why she got records that day. No public request document was filled out so that we would know what she took that day. And your star witness is Justine Boone who I would love to haul back here to the City of Lafayette and put him on the stand for some of his accountability to the Citizens of Lafayette and where his loyalties lied. You are not privy to a conversation I had where exposed some of you. I have witness. Diane Rinks cannot even say 100% with the access that was given that no personal information was leaked. A legal confidential paper was copied. Leah has no public document training.

I want to thank Dean Rhodes for doing his best to try and help me since no one else would. And I would like to ask you Chris Pagella WHAT ARE YOU HIDING? WHAT ARE YOU AFRAID OF. All of this will be coming out it is just a matter of time. Patience.

Vote against 'stacking' council

Mayor Heisler and Counselors Chris Pagella and Leah Harper want total control over Lafayette. They say they speak for the citizens, but only a few attend council meetings, and I see the same ones each time.

They don't speak for me nor do they listen to me because I am not part of their regime. If you are not with them, watch out. You will be treated like an enemy, a hostile combatant. I wish citizens would attend meetings so they could see the aggressiveness and dominance these people show. What will become of the city of Lafayette?

In meetings, there is bullying, intimidation, harassment, scare tactics, etc. But these things don't work on me like they do on others. I won't go away.

The regime wants to recall Councilors Bob Cullen and Dean Rhodes because they don't agree with them - so they have to go. I bet they wish they could also recall Counselors Nick Harris and Michael Roberts, but that would be too obvious in their presumed ultimate plan for stacking the council in their favor.

Do you really want this type of leadership after they spread all the horrible untruths, slander and lies about people, saying they speak for the citizens? I know I don't. This recall is costing taxpayers $6,000, and they want to talk about costs. Then they run a senseless recall now despite the elections this November. The other three should be recalled.

This recall proves what other recalls have proven: nothing changes. I have learned one thing: You can put anything you want on a recall ballot against someone, regardless of its truth. It makes me sick. That's how Debbie sees it. Vote No on the recall.

RE: New Complaint against Councilor Leah Harper

I usually don’t go to newlafayette.org, but I am shocked and amazed at what I have read. Let me lay out exactly what was said Wednesday May 19th 2010 that prompted me to write my first complaint. Michael Roberts Brought out that the Counselors are running their decisions and beliefs and judgments, etc…. on the basis of transparency. So Leah Harper was brought up regarding some copies that were made. This is how Leah Harper appeared to explain it to the Counselors and those of us constituents. I am not quoting and I would like a copy now from the meeting to compare to what she is now stating on this website they are two different explanations that she states are the truth. I am so confused.

I spoke to Justin Boone the City Administrator and asked him about Public Documents. I had a person who wanted some Public Documents and I wanted to know how it was done. Justine Boone told me that as long as a Counselor was present that the person could make copies of the Public Documents. So I was present Justin said it was this drawer and the Gentleman went through the drawer and copied or scanned all the documents he wanted. Questions were asked by Counselors such as who was the person. She was vague and just said he wasn’t a resident of Lafayette. Questioned about what the documents were she stated she didn’t know what all the documents were but she could find out. She continued to be vague.

I was getting very frustrated and again I would like the notes of the meeting that just pertain to this situation so we can see exactly how she answered these questions. Another gentlemen in front of me wanted answers and wants an investigation started into the actions of Counselor Leah Harper and I second that. I have already put together one complaint but now she has given me more reason to show her dishonesty and reason to believe her motives as a Counselor went against City Policy. There is a procedure set in place that the Counselors can get all the copies they want they just have to ask Trena and fill out the proper paperwork. Leah Harper went around this system knowingly and willingly.

It states in this Web Page her Motives I along with a consultant involved in our current water investigation, went to City Hall to obtain Public Water Records. She admits she knowingly and willingly knew what she was doing. I would like her to elaborate on this consultant. What type of a consultant is he? Is the City paying for it? Does the Attorney know about all this that is going on? She is now say that Justin Boon said for her to oversee it. That is not exactly how it was presented to us that night at the Counsel Meeting.

She admits to the full access to Public Records so why didn’t she get them herself? Why use someone else whom we don’t know and putting the whole community on edge now because we don’t know if our privacy has been invaded. She states that it is her responsibility to maintain oversight at City Hall again there are procedures in place to obtain these copies. Perhaps this Gentlemen is not a Consultant but has very good Technological skills to scan things and obtain information for Counselor Leah Harper something she couldn’t do on her own. Just a thought because again I am confused she had access to this information and I would like a business card from this gentleman stating he is a water consultant. She states that this opportunity to scan Public Water Documents was NECESSARY in forwarding the water investigation. Was it really worth the expense of now the community thinking that personal information got out, or it was totally sneaking, or he didn’t have to pay and we do, or it was deceiving, or her reputation is at stake, just to name a few. But the biggest is the cost of the mindset of a person that is not from this city having access to who knows what and copied or scanned who knows what. Now we have two stories. What are we really supposed to believe. In most police cases they say once you cover up something and you come up with another story most likely that story is probably untrue also. Who is to believe a thing now? These Political Motive games are costing the Citizens of Lafayette everything. Especially trust with People who are suppose to have our best interest at heart. Sorry but when I believe given two different stories now that you might have lied and deceived you don’t have my best interest at heart.

So it goes on to say that she does have some paperwork into the City with Trena. But I guess she was just not patient enough to go through the proper procedures to wait for it. She states that I want a break down and accountability of how this money was spent, but had not been able to obtain the information from Trena McManus, who is assistant to the City Administrator. I would like Trena to be able to respond to this. It still doesn’t give Counselor Leah Harper the right to therefore take it upon herself and put our city at risk and take what she wanted with supposedly a person who is a Consultant water person again I believe he just had great skills in scanning for her. Just a guess.

Counselor Leah Harper was directed to a file Cabinet that apparently contains all the public (not Private) records related to Lafayette’s water she states. Doesn’t that make everyone feel good now that the word apparently is used? But remember just the Counselor and the Gentlemen from out of town were left in the room alone. So does it really matter what drawer? They should have never been left alone and they should have never had access to drawers of the City of Lafayette. She states no staff time was spent. That is correct. Because proper procedure is Trena is present and knows is exactly what is going on at all times. But she wasn’t there that day to oversee everything. So of course the scary word used here is no Trena Supervising. It doesn’t matter how she feels about the public having to pay for public records. Everyone feels that way and they are supposedly trying to change that but that still doesn’t give you that right to go take them your self without going through proper procedures. What else are you capable of doing to get what you want?
Scares me! We all have to go through the process regardless of the time it takes. No excuses. I guess we can all storm down to City Hall ask what drawer and skip the procedures part and not pay because our great Counselor Leah Harper took it upon herself to set precedent to get any way shape or form even if it meant going around the system.

Yes we will see online the documents supposedly she got, but how do we really know that it is all the documents, we will never know? We have to trust these two people now. UH OH. And she states that due to time constraints there was limited information, THANK GOD. Counselor Leah you are right I did say that I cannot afford the documents and that is why I should get a big credit from what you owe the City now since your Consultant obtained the documents so I can get my records. They have these rules and regulations for a reason. Many people are pushing to change these rules but does that give us the right to find ways to go around the system or to beat the system or to cheapen the system. As a Counselor I cannot believe one would do this. You have rights so does your consultant to get these records under the ordinance. But there are city procedures that I know that through the records will show that you have probably gone through yourself in the past, and even stating that you are trying to change it because of the cost and everything, acknowledges you know the procedures.

We now have two different explanations from Councilor Leah Harper. Please compare the notes from the Meeting dated Wednesday May 19th, 2010 and this response from her personally and tell me which one we are supposed to believe. I would like to ask that Councilor Leah Harper be censored on her Public Records Documents because we can now no longer trust her actions. Actions speak louder than words.

I am still extremely worried about my privacy rights especially now knowing she meant to do this and in this manner exposing documents to a person outside our community for her personal gain. The thought that the two of them had access to everything and was unsupervised is an extremely scary thought. I hope and pray you do something. If not I will continue to write you letters and documents this for who knows how long. I will figure something out to make you look at this situation seriously.

RE: Counselor Leah Harper & Public Records

1. I would like Justin Boone to answer to last Wednesday as to what exactly took place conversation wise and then between him and Leah Harper regarding the Public Documents Procedures.

2. I would like to know what responsibility as to his presence in this situation was.

3. Justin is still on City Payroll until Friday May 21, 2010 so you can still contact him he is just on paid leave and then on Monday is when he starts his severance package. He is still under the City Payroll.

4. I would like a full investigation into this matter because Leah Harper claims Justin told her the policy but I would like Trena to look up to see if Leah has asked for Public Documents. Plus I believe that there is record of I am not positive but when she went after Diane Rinks she was upset about all the charges. So she already knows about the Public Document Procedures. Why she would go on record and say that she didn’t know it which would lead to a lie I don’t know but I would like to know if that is true. If she has asked for Public Documents Copied or Research at some old Counsel meetings when she proposed these issues to Diane Rinks the previous City Administrator that would prove that she lied to the other Counselors, Attorney, and Citizens. At least we will get to the truth.

5. She wouldn’t tell us the person’s name. Although it is supposed to be all public record. Then she stated he lived out of the city. Another citizen stated he lived in Lafayette can that be verified to see if that was misleading to.

6. I am very nervous and upset now because I have a history with Identity problems and to know that a Councilor might have put me at risk not knowing for sure what all was done according to her. The person now having to get all that information to the City.
The City has let me down as a citizen in this community. You have no way now to prove what he took and whether it was personal or not. It is two people’s words. Legally you can’t prove that he didn’t. Mentally you don’t know how this affects a person. Leah Harper needs to be held accountable.

7. The person needs to be charged for the copies.

8. I don’t know what Leah’s motives or the other gentlemen’s motives were but it might have caused more damage to the city than Leah could have imagined. Your right people have a right to Public Documents yes but now knowing how it was done I
question whether or not if it was only Public Documents. Something is wrong with this picture.

9. Please get back to me in a timely manner while I make all the calls necessary to find out what actions I can take against the city for possibly leaking who knows what information out to a citizen for who knows what reason. And a City Counselor happens to be the one who is present during the situation.

10. If actions need to be taken against that Counselor as in her resignation it needs to be done.

I will go on record that I asked Chris Pagella to keep the people in the audience to stop making remarks and talking to one another. His answer was to my best knowledge “its not bothering me, move as far away, etc” we will have to go to the tapes. It is the Mayor
responsibility or the acting person in charge to take those concerned citizens complaints and keep the audience quiet while they are speaking. Chris Heisler has been respectful to me but last night I was treated very disrespectful. I want it noted on record that these
meetings need to be held in better order. I am tired of hearing the same people make comments in the audience. If they can’t control their mouths you make them leave. That is how they are to be run. There is no reason why they cannot control their mouths and
comments during Councilors talking. If a Mayor cannot control the meeting than something needs to be done. We know who the people are its very simple you give them warnings and then finally you give them consequences. I am going to hold Mayor Chris
Heisler accountable especially when his wife blurts out things during the meetings. As I should be accountable for my actions to. Please send me a copy of the rules on Council meetings and how the audience is to be dealt with during the meetings to find out if the City of Lafayette is following those Guidelines.
